A couple cannot file for divorce in Georgia unless one spouse has lived in the state for at least six months or Georgia was the most recent state where the couple lived. Although the state allows for fault in divorce, most divorces are filed because the marriage is “irretrievably broken.”

If you and your spouse agree on the terms of the divorce (child custody and visitation, property division, alimony, child support), you can file an uncontested divorce. While an uncontested divorce may take significantly less time and will not be as complicated as a contested divorce, it is still wise to involve an attorney.

Due to the expense, time and uncertain nature of litigation, many divorces are resolved through negotiations between the parties. In some cases, mediation may lead to settlement of the case. In an attempt to save money and give our clients more control over the outcome of their divorce, we generally try to resolve matters through negotiations or mediation. If the other party is not reasonable, however, we will proceed with litigation as necessary to conclude the divorce.
